DECISION AND ORDER STATEMENT OF THE CASE Upon petition duly filed by United Automobile, Aircraft and Agri- cultural Implement Workers of America, C. I. 0., herein called the U. A. W., alleging that a question affecting commerce had arisen concerning the representation of employees of Sterling Pump Cor- poration, Hamilton, Ohio, herein called the Company, the National Labor Relations Board provided for an appropriate hearing upon due notice before Alba B. Martin, Trial Examiner. Said hearing was held at Cincinnati, Ohio, on February 25, 1942. The Company, the U. A. W., and Patternmakers League of North America, herein called the League, appeared, participated, and were afforded full oppor- tunity to be heard, to examine and cross-examine witnesses, and to introduce evidence bearing on the issues. The Trial Examiner's rul- ings made at the hearing are free from prejudicial error and are hereby affirmed. 41 N. L R. B, No 222. 1219 1220 DECISIONS OF NATIONAL LABOR RELATIONS BOARD On June 12, 1942, the Company, the U. A. W., and the League entered into a stipulation. The stipulation is hereby approved and made a part of the record in these proceedings. Upon the entire record in the case, the Board makes the following : FINDINGS OF FACT As appears from the stipulation of the parties, the Company sold all its assets after the close of the hearing and is no longer engaged in business. The Company employs no person at this time and is in the process of liquidating its assets and liabilities. Under these .circumstances, we shall dismiss the petition. IT IS HEREBY ORDERED that the petition for investigation and cer- .tification of representatives of employees of Sterling Pump Corpora- .,tion,.
