Feb. 25, 2010) Copy Citation Hartford, CT UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD STATE OF CONNECTICUT Employer and Case 34-WH-2 CONNECTICUT STATE EMPLOYEES ASSOCIATION, SERVICE EMPLOYEES INTERNATIONAL UNION, LOCAL 2001 Petitioner CERTIFICATION OF REPRESENTATIVE AS BONA FIDE UNDER SECTION 7(B) OF THE FAIR LABOR STANDARDS ACT OF 1938 On October 26, 2009, Connecticut State Employees Association, Service Employees International Union, Local 2001 filed with the Regional Director for Region 34 of the National Labor Relations Board a request for certification of representative as bona fide under Section 7(b) of the Fair Labor Standards Act of 1938 (FLSA), 29 U.S.C. Sec. 207(b). On November 4, 2009, the Acting Regional Director served on the parties a Notice to Show Cause why the Board should not grant the request. No response was filed. As the Region's investigation revealed that the Petitioner is the recognized collective-bargaining representative of the unit employees, 1 the 1 The record indicates that on December 15, 1976, the Connecticut State Board of Labor Relations issued a Decision and Certification of Representative certifying the Union as the exclusive collective-bargaining representative of the employees in the unit. In addition, the record includes a copy of the parties' recent collective-bargaining agreement, effective from July 1, 2005 through June 30, 2009, which has been extended from June 30, 2009 through June 30, 2012, by a memorandum of understanding executed by the parties on April 17, 2009. Regional Director recommended to the Board that the requested certification be granted. No party having shown cause why a certification should not be issued, the National Labor Relations Board certifies that Connecticut State Employees Association, Service Employees International Union, Local 2001 is a bona fide representative, for purposes of Section 7(b) of the FLSA, of the employees of the State of Connecticut in the following unit:2 Unit P4 Engineering, Science and Related, and Data Processing classifications described in the list attached to the Decision and Certification of Representative issued by the Connecticut State Board of Labor Relations, employed by the State of Connecticut.
