Board consolidated the cases and provided for an appropriate hearing ,upon due notice before John J. Cuneo, Trial Examiner. Said hearing was h'e'ld at Elizabeth, New•Jersey, on June 14, 1944.. The.Companies, the Independent, and-Oil Workers International Union, Local 1000-I, C. I. 0., herein called- the C. I. 0.,3 appeared, participated, and were afforded' full opportunity to be heard, to examine and cross-examine ,witnesses,-and to introduce evidence bearing on the issues. The rul- ings of the Trial Examiner made at the hearing are' free from preju-\ dicial error and are hereby affirmed. -All parties were afforded oppor- tunity to file briefs with the Board. The C. I. 0. moved at the hearing to dismiss'the petitions of the Independent filed in Cases Nos. 2-R-4398 and 2-11-4813 on the ground that the Independent is a continuation of, or a successor to, Bayway Refinery Employees' Association which the Board had previously ordered disestablished. Ruling on the motion was reserved for the Board. Inasmuch as this is a representation case and not a com- plaint, proceeding, we do riot consider the motion-appropriate, and it is hereby denied. Upon the entire record in the case,4 the Board makes the following FINDINGS OF FACT 1. THE BUSINESS OF THE COITPANIES Standard Oil Compliny of New Jersey, a Delaware corporation, is a wholly owned subsidiary of Standard Oil Company, a New Jersey corporation. Standard is engaged in the refining of crude petroleum and the production, sale, and distribution of gasoline and allied"prod ucts. It maintains it principal office in, the State of Delaware, and an executive office and place of business in New York City. It owns and operates refineries in Maryland, South Carolina, and New Jersey. Only"is Bayway Refinery at Linden, New Jersey, is involved in the present proceedings. The Bayway Refinery, together with' a refinery located at Bayonne, New Jersey, comprise Standard's New Jersey Works. During the year 1943, over 36,500,000 barrels of crude oil, valued in excess of $58,400,000, were .purchased by Standard from points outside the State of New Jersey ' for use at the New Jersey Works. Sub-products, having a' stantially more than 50,percent of its products was shipped from the New, Jersey Works to points outside the State of-New Jersey. Stanco, Incorporated, is also a Delaware corporation wholly owned by Standard'Oil Company. It is engaged in the manufacture, process- ' Sing, and distribution of mineral oils, spray oils, petroleum solvents, petroleum specialty products, insecticides and pharmaceuticals, in- cluding allied products, and also operates a centralized packaging unit for these products and" other products processed by Standard Oil Company and its affiliates, who in'turn ship in excess of 50 percent of such packaged products to various points outside the Sate of New Jersey::.,Stanco maintains a principal office in the State of Delaware, and an executive office in the State of New York. It operates- a plant .within the confines of the Bayway Refinery, which is involved in the present proceedings. The principal raw materials used by Stanco are petroleum distillates, naphthas, petroleum alcohols, wax, kerosene, insecticide concentrate, petrolatum, and various medicinal compounds and solvents made from petroleum. During the year 1943, Stanco purchased raw materials valued,in'excess of $1,100,000, of which sub- stantially more than 50 percent was shipped to its plant from points outside 'the' State 'of New Jersey. During ^ the ^ same; period, .Stanco manufactured, processed,' packaged, and distributed petroleum and allied products having a value in excess of $7,000,000, of which sub- stantially more-than 50 percent was shipped from the plant to points' outside the State of New Jersey. The Companies admit that they are engaged in commerce within the meaning-of the National Labor Relations Act. IT. THE ORGANIZATIONS INVOLVED Independent Petroleum Workers of New Jersey is an unaffiliated labor 'organization, admitting to membership employees of the Companies. Oil Workers International Union, Local 1000-I, is a labor organiza- tion affiliated with the Congress of Industrial Organizations, admit- ting to membership employees of the Companies. III. THE QUESTION CONCERNING REPRESENTATION On or about November 23, 1943, the Independent mailed a letter to the Companies in which it requested recognition as the collective bar- gaining representative of employees at the Bayway Refinery. In a reply dated November 24,1943, the Companies advised the Independent to use the processes of the Board. 654 DECISIONS OF NATIONAL LABOR RELATIONS BOARD Statements of a Field-Examiner of the Board, introduced into evi- dence at the hearing, have been compiled in a table below.5 These statements indicate that the Independent represents a substantial num- ber of employees in the units-it alleges to be appropriate. We find that questions affecting commerce have arisen concern- ing the representation of employees of the Companies, within the, meaning of Section 9 (c) and Section 2 (6) and (7) of the, Act. - IV. THE APPROPRIATE UNIT We find, in accordance with stipulations of the parties,e that each of the following groups of the Companies'. employees constitutes a unit appropriate for the purposes of collective bargaining, within the, meaning of Section 9 (b) of the Act:' 1. (Case No. 2-R-4398) All operating, mechanical, and main-, tenance employees at the Bayway Refinery, including all watchmen and non-militarized guards, but excluding all militarized, guards, clerical employees, professional and technical employees,, laboratory employees, and all executive a"nd' supervisory employees ,=with au-1 thority to hire, promote, discharge, discipline, or otherwise effect changes in the status of employees, or effectively recommend such action.' . • ° 2. (Case No. 2-R-4773) All clerical employees in the factory and general offices at the Bayway Refinery, including timekeepers, drafts- men, expediters, photographers, telephone operators, field corps men, safety 'inspector-gas testmen, X-ray technicians and physiotherapists, blood testers, trained nurses, shift first-aid men, purchasing repre- sentatives, cafeteria employees, and clerical employees in the man- ager 's' office of the New Jersey Works, the office of the Chief Safety Engineer, and the Technical Service Division located at the Bayway Refinery, but excluding all' part-time cafeteria employees, and all executives and supervisory employees with authority to hire, promote, e See the following table. THE 1ETEREIINAIION OF REPRESENTATIVES We shall direct that the questions concerning representation which have arisen be resolved by separate elections by `secret ballot among the employees of the Companies in the units found appropriate in Section IV, above, who were employed during the pay-roll period - iminediately';pr-eceding the date, of the Direction.of Elections -herein, subject to the limitations and additions set forth therein."
