Employer and Case 7-RC-23330 DISTRICT LODGE 60, INTERNATIONAL ASSOCIATION OF MACHINISTS AND AEROSPACE WORKERS, AFL-CIO Petitioner DECISION AND CERTIFICATION OF RESULTS OF ELECTION The National Labor Relations Board has considered challenged ballots in an election held March 10, 2010, and the hearing officer's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The corrected tally of ballots shows 12 ballots cast for and 13 ballots cast against the Petitioner, with 2 challenged ballots, a sufficient number to affect the results. No exceptions have been filed to the hearing officer's report within the time provided. Accordingly, the Board adopts the hearing officer's findings and recommendations,' and finds that a certification of results of election should be issued. We adopt the hearing officer's recommendation to sustain the challenge to the ballot of Brian Trees. Thus the challenge to the ballot cast by Derek Szpytek is no longer determinative. CERTIFICATION OF RESULTS OF ELECTION IT IS CERTIFIED that a majority of the valid ballots have not been cast for District Lodge 60, International Association of Machinists and Aerospace Workers, AFL-CIO, and that it is not the exclusive collective-bargaining representative of these bargaining unit employees.
