Employer and Case 06-RC-1 2743 TEAMSTERS LOCAL UNION NO. 205 AFFILIATED WITH THE INTERNATIONAL BROTHERHOOD OF TEAMSTERS Petitioner DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board has considered challenged ballots in an election held May 20, 2010 and May 21, 2010, and the Regional Director's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The original tally of ballots shows 35 ballots cast for and 33 ballots cast against the Petitioner, with 4 challenged ballots, a sufficient number to affect the results. No exceptions have been filed to the Regional Director's report within the time provided. Accordingly, the Board adopts the Regional Director's findings and recommendations, and finds that a certification of representative should be issued.' ' The Re ' gional Director recommended sustaining the challenges to the four ballots. Thus, the revised tally of ballots shows 35 ballots cast for and 33 against the Petitioner, with no challenged ballots. CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for Teamsters Local Union No. 205 affiliated with the International Brotherhood of Teamsters and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All full-time and regular part-time production and maintenance employees, including production operators, maintenance mechanics, laboratory technicians, shipping and receiving employees, MRO buyers and traffic coordinators employed by the Employer at its Donora, Pennsylvania, facility; excluding all office clerical employees and guards, professional employees and supervisors as defined in the Act, and all other employees.
