On 1 December 2017, Junior Party Metsä Fibre Oy filed a notice that it has 1
abandoned its involved application 14/401,166. (See Paper 8.) We construe this as 2
a request for adverse judgment. 37 CFR § 41.127(b)(1). Accordingly, we enter 3
judgment against Junior Party. 4
It is ORDERED that claims 1, 3, 5, 7-9, and 12-20 of application 14/401,166 5
be FINALLY REFUSED (see Declaration, Paper 1, at 5; 35 U.S.C. § 135(a)1). 6
It is FURTHER ORDERED that a copy of this judgment be entered into the 7
files of application 14/401,166 and Patent 8,980,050. 8
It is FURTHER ORDERED that the parties are directed to 35 USC § 135(c) 9
and 37 C.F.R. § 41.205 regarding the filing of settlement agreements. 10
