Employer and INTERNATIONAL UNION OF OPERATING ENGINEERS, LOCAL UNION NO. 103 and LABORERS INTERNATIONAL UNION OF NORTH AMERICA, LOCAL UNION NO. 213 Joint Petitioners and INTERNATIONAL BROTHERHOOD OF ELECTRICAL WORKERS, LOCAL 1393 Intervenor Case 25-RC-062774 DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board has considered an objection to an election held February 13, 2012, and the Hearing Officer's report recommending disposition of it. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 8 ballots cast for the Joint Petitioners, 12 ballots cast for the Intervenor, and 0 ballots cast against the participating labor organizations. There was 1 challenged ballot, an insufficient number to affect the results. No exceptions have been filed to the Hearing Officer's report within the time provided. Accordingly, the Board adopts the Hearing Officer's findings and recommendations, and finds that a certification of representative should be issued. 2 CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for International Brotherhood of Electrical Workers, Local 1393 and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All equipment operators, groundmen, groundmen truck driver, signal technicians and signal foremen employed by the Employer; but excluding all office clerical employees, professional employees, employees currently employed under a collective bargaining agreement, guards and supervisors as defined in the Act, and all other employees.
