Further, the Union has failed to establish any other legal basis for revoking the subpoenas. See generally NLRB v. North Bay Plumbing, Inc., 102 F.3d 1005 (9th Cir. 1996); NLRB v. Carolina Food Processors, Inc., 81 F.3d 507 (4th Cir. 1996). Dated, Washington, D.C., April 5, 2013 MARK GASTON PEARCE, CHAIRMAN RICHARD F. GRIFFIN, JR., MEMBER SHARON BLOCK, MEMBER 1 The Region’s opposition brief states that the Region has obtained a copy of the March 10, 2010 to December 31, 2012 collective-bargaining agreement and therefore the Region no longer seeks production of that document. In considering the petition to revoke, we have evaluated the subpoena duces tecum as modified in this manner. Copy with citationCopy as parenthetical citation
