Sumner Lawrence, of counsel to the Board. k DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE ' o n''March 31, 1942, International Association of Machinists, Lodge 311, AFL, herein, called the Machinists, filed with the Regional Di- rector for the Twenty-first Region (Los Angeles, California) a petition alleging that a question affecting commerce had arisen con- cerning the representation of employees of Sawyer Electrical Manu- facturing Company, Los Angeles, California, herein called the Com- pany, engaged in the manufacture of electrical equipment and appurtenances, and requesting an investigation and certification of representatives pursuant to Section 9 (c) of the National Labor Re- lations Act, 49 Stat. 449, herein called the Act. On April 9, 1942, the National Labor Relations Board, herein called the Board, act- ing' pursuant to Section 9 (c) of the Act, and Article III, Section 3, of National Labor Relations Board Rules and Regulations-Series 2, as amended, ordered an investigation and authorized the Regional Director to conduct it and to provide for an appropriate hearing upon 'due notice. ' On April 9, 1942, the Company, the Machinists, and United Electrical, Radio & Machine Workers of America, Local 1421, C. I. 0., herein called the United, a labor organization claiming to represent employees directly affected by the investigation, entered into a "STIPULATION FOR CERTIFICATION UPON CONSENT ELECTION." 40 N. B., No. 212. 1215 1216 DECISIONS OF NATIONAL LABOR RELATIONS BOARD Pursuant to the stipulation, an election by secret ballot was con- ducted on April 17, 1942, under the direction and supervision of the Regional Director among the following employees to determine whether they desired to be represented by the United, or by the Ma- chinists, for the purposes of collective bargaining, or by neither; all production and maintenance employees, excluding clerical employees, watchmen, technical employees, the superintendent, and departmental foremen. On April 21, 1942, the Regional Director issued and duly served upon the parties his Election Report on the ballot. No ob- jections to the conduct of the ballot or to the Election Report have been filed by any of the parties. Lodge 311, A F L--------------------------------------------- 62 Votes cast for Neither------------------------------------- 14 Upon the basis of the stipulation, the Election Report, and the entire record in the case, the Board makes the following: FINDINGS OF FACT 1. A question affecting commerce has arisen concerning the repre- sentation of employees of ' Sawyer Electrical Manufacturing Com- pany; Los Angeles, California, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act.' 2. All production and maintenance employees of the Company, excluding clerical employees, watchmen, technical employees, the superintendent, and departmental foremen, constitute a unit appro- priate for the purposes of collective bargaining, within the meaning of Section 9 (b) of the National Labor Relations Act. 3. International Association of Machinists, Lodge 311, AFL, has been designated and selected by a majority of the employees in the above unit as their representative for the purposes of collective bar- gaining and is the exclusive representative of all the employees in said unit, within the meaning of Section 9 (a) of the National Labor Relations Act. SAWYER ELECTRICAL MANUFACTURING COMPANY 1217 CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Re- lations Act, - - IT IS HEREBY CERTIFIED that International Association of Machinists, 'Lodge 311, AFL, has been designated and selected by a majority of all production and maintenance employees of Sawyer Electrical.
