ORDER DENYING MOTION FOR RECONSIDERATION1
The Respondent’s motion for reconsideration of the Board’s Decision and Order
reported at 370 NLRB No. 78 (2021) is denied. The Respondent has not identified any
material error or demonstrated extraordinary circumstances warranting reconsideration
under Section 102.48(c)(1) of the Board’s Rules and Regulations.2

1 The National Labor Relations Board has delegated its authority in this proceeding to a
three-member panel.
2 We note that not only did the Region follow Sec. 102.4 of the Board’s Rules and Regulations
with respect to regular, certified, and email service of pleadings and other pertinent
documents in this case, but also that the email address that the Respondent provided to the
Region on January 22, 2021, is the same email address that the Region used in serving the
Respondent with documents in 2020. Specifically, the Region used that email address to
serve the Respondent with the complaint on October 30, the Region’s warning letter on
November 18, and the motion for default judgment on December 3.
