Case No. 8-9608 CERTIFICATION OF REPRESENTATIVES August 23, 1941 On June 27, 1941, the National Labor Relations Board, herem called the Board, issued its Decision and Direction of Election in the above-entitled proceeding.' Pursuant to the Direction of Elec- tion, an election by secret ballot was conducted on July 25, 1941, under the direction and supervision of the Regional Director for the Second Region (New York, New York). On July 29, 1941, the Re- gional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties his Election' Report. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. B., No. 107. 864 ROBINS DRY DOCK & REPAIR COMPANY 865 IT IS HEREBY CERTIFIED that Industrial Union of Marine and Ship- building Workers of America, Local 39, affiliated with the Congress of Industrial Organizations, has been designated and selected by a majority of all production and maintenance employees at the Com- pany's Erie Basin Yard, including snappers (or subforemen), watch- men, floating-equipment men, tool keepers, garage men, storeroom workers, and practical or operating engineers, but excluding dock hands, store keepers in the safety-equipment room, technical engi- neers, chauffeurs, traffic-department dispatchers, timekeepers, jani- tresses, draftsmen, office and clerical employees, supervisors, foremen, and assistant foremen, as their representative for the purposes of collective bargaining and that, pursuant to Section 9 (a) of the Act, Industrial Union of Marine and Shipbuilding Workers of America, Local 39, affiliated with the Congress of Industrial Organizations, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
