Case No. R-3608 CERTIFICATION OF REPRESENTATIVES June 10;1942 On May 5, 1942, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above- entitled proceeding.' Pursuant to the Direction of Election, an elec- tion by secret ballot was conducted on May 22, 1942, under the direc- tion and supervision of the Regional Director for the Second Region (New York City). On May 25, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. I. 0., has been designated and selected by a majority of all office, clerical, secretarial, and accounting employees of RKO Radio Pictures, Inc., employed in the RKO building, 1270 Sixth Avenue, 140 N L R B 1185 41 N. L. R. B., No. 158. 900 RKO RADIO PICTURES, INC. 901 New York City, including particularly auditors; accountants; book- keepers; bookkeeping machine operators; comptometer operators; accounting, contract, file, mail, print and negative, playdate, pub- licity, purchasing, research, sales, scenario, statistical, talent typing, and general clerks; page boys; receptionists; reproduction machine operators, including ditto, mimeograph, multigraph, photostat, and addressograph machine operators; secretaries, statisticians; stenog- raphers; statistical typists; tabulating machine operators, including keypunch, sorter, verifier, and printer machine operators ; telegraph operators; and typists; but excluding executives; officers; traveling auditors; lawyers; supervisory employees having' the power to hire and discharge or the duty to make recommendations concerning they-, hire and discharge of employees, wage increases, or other adjustments of working conditions (such supervisory employees being included in Appendix "A," attached hereto) ; and employees who come within the bargaining units found appropriate by the Board in Matter of RKO Radio Pictures, Inc. and Screen Publicists Guild, 'Case No. R-23'49, and Matter of RKO Radio Pictures, Inc. and Screen Readers Guild of New York, Case No. R-2554, regardless of whether or not the employees in such units are covered by - a collective bargaining contract or contracts with RKO Radio Pictures, Inc., as their repre- sentative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act,_Screen Office and Professional Employees Guild, Local 109, United Office and Professional Workers of America, C. I. 0., is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, -hours of employment, and other conditions of employment.
