RIETH-RILEY CONSTRUCTION COMPANY, INC. and Case 07-CA-234085 LOCAL 324, INTERNATIONAL UNION OF OPERATING ENGINEERS (IUOE), AFL-CIO ORDER1 Respondent Rieth-Riley Construction Company, Inc.’s (Rieth-Riley’s) request for special permission to appeal from Administrative Law Judge Charles J. Muhl’s April 9, 2021 Order granting the Acting General Counsel’s motion to amend the complaint is denied. Rieth-Riley has failed to establish that the judge’s Order cannot be appropriately addressed at a later stage of this proceeding. Moreover, Rieth-Riley’s argument fails to show that the judge abused his discretion in finding that the proposed amendment is just. See Section 102.17 of the Board’s Rules and Regulations. Dated, Washington, D.C., June 22, 2021. LAUREN McFERRAN, CHAIRMAN 1 The National Labor Relations Board has delegated its authority in this proceeding to a three-member panel. 2 WILLIAM J.
