DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE Upon petition duly filed by The Brotherhood of Steel Workers,, unaffiliated, herein called the Union, alleging that a question affecting commerce had arisen concerning the representation of employees of Union Drawn Steel Division of Republic Steel Corporation, Gary, Indiana, herein called the Company, the National Labor Relations Board provided for an appropriate hearing upon due notice. On April-16, 1942, before a hearing was held, the Company, the Union, and the Acting Regional Director for the Thirteenth Region (Chi- cago, Illinois), entered into a "STIPULATION FOR CERTIFICATION UPON PAYROLL CHECK." Pursuant to the stipulation, a check of the Union's records of mem- bers in good standing as of Mareh-30, 1942, against the Company's pay roll of April 16, 1942, was made under the supervision of the Acting Regional Director. On April 21, 1942, the Acting Regional Director, pursuant to the stipulation, issued a Payroll Check Report, copies of which were duly served upon the parties. No objections to the conduct of the pay-roll check or to the Payroll Check Report have been filed by the parties. In his Report, the Acting Regional Director reported that the check of the Union's records and the Company's pay roll showed that 98 ' Incorrectly designated "Brotherhood of Steel Workers" in the petition and amended petition 40 N. L. R. B., No. 251. 1405 1406 DECISIONS OF NATIONAL LABOR RELATIONS BOARD of 129 employees -in the agreed appropriate unit were members of the Union in good standing as of March 30, 1942. Upon the basis of the stipulation, the Payroll- Check Report, and the entire record in the case, the Board makes the following : FINDINGS OF FACT 1. A question affecting commerce has arisen concerning the rep- resentation of employees of Union Drawn Steel Division of Republic Steel Corporation, Gary, Indiana, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act. 2. All production and maintenance employees of Union Drawn Steel Division of Republic Steel Corporation at its Gary, Indiana, plant, excluding foremen, assistant foremen, supervisors who do not work with tools, draftsmen; timekeepers, first-aid men and nurses, watchmen, and office and salaried employees, constitute a unit ap- propriate for the purposes of collective bargaining, within the mean- ing of Section 9 (b) of the National Labor Relations Act. 3. The Brotherhood of Steel Workers, unaffiliated, has been desig- nated and selected by a majority of the employees in the appropriate unit as their representative for the purposes of collective bargaining, and is the exclusive representative of all employees in said unit, within the meaning of Section 9 (a) of the National Labor Relations Act. CERTIFICATION OF REPRESENTATIVES Br virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, IT IS HEREBY. CERTIFIED that The Brotherhood of Steel Workers, unaffiliated, has been designated and selected by a majority of all production and maintenance employees of Union Drawn Steel Divi- sion of Republic Steel Corporation at its Gary,. Indiana, plant, excluding foremen, assistant foremen, supervisors who do not work with tools, draftsmen, timekeepers, first-aid men and nurses, watch- men, and office and salaried employees, as their representative for the purposes' of collective bargaining, and that, pursuant to the provisions of Section 9 (a) of the Act, The Brotherhood of Steel Workers, unaffiliated, is the exclusive representative of all such em- ployees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employ- ment.
