DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE On September 8, 1941, Bricklayers, Masons and Plasterers Inter- national Union of America, Local 21 of Illinois, herein called the Union, filed with the Regional Director for the Thirteenth Region (Chicago, Illinois) a petition alleging that a question affecting com- merce had arisen concerning the representation of employees of Repub- lic Steel Corporation, Cleveland, Ohio, herein called the Company, engaged in the manufacture, sale, and distribution of iron and steel products and maintaining plants at South Chicago and Grand Cross- ing, Illinois, and requesting an investigation and certification of repre- sentatives pursuant to Section 9 (c) of .the National Labor Relations Act, 49 Stat. 449, herein called the Act. On October 14, 1941, the National Labor Relations Board, herein called the Board, acting pur- suant to Section 9 (c) of the Act, and Article III, Section 3, of National Labor Relations Board Rules and Regulations-Series 2, as amended, ordered an investigation and authorized the Regional Director to con- duct it and to provide for an appropriate hearing upon due notice. On October 14, 1941, the Company, the Union, and the Board entered into a, "STIPULATION FOR CERTIFICATION UPON PAY- ROLL CHECK.". The Stipulation, which was expressly made sub- 36 N. L. R. B., No. 151. 702 REPUBLIC STEEL CORPORATION 703 ject to the approval of the Board, was considered and approved by the Board on October. 15, 1941. Pursuant to the Stipulation, the Regional Director checked the paid-up dues and membership records of the Union against the Company's pay roll of September 20, 1941, to determine the number of bricklayers, employed at the South Chicago and Grand Crossing, Illinois, plants of the Company, who had designated the Union as their bargaining agent. On October 16, 1941, the Regional Director issued and duly served upon the parties his Pay Roll Check Report. No objections to the conduct of the check or to the Pay Roll Check Report, have been filed by any of the parties. As to the pay-roll check and the results thereof, the Regional Director reports as follows: Total number on eligibility list------------------------------- 25 Total number of names challenged---------------------------- 0 Total number of employees on the eligibility list whose names appeared as paid-up members in the dues records of the union------------------------------------------------------ 25 Upon the basis of the Stipulation, the Pay Roll Check Report, and the entire record in the case, the Board makes the following : FINDINGS OF FACT 1. ' A question affecting commerce has arisen concerning the repre- sentation of employees of Republic Steel Corporation, Cleveland, Ohio, at its South Chicago and Grand Crossing, Illinois, plants, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act. 2. All bricklayers of the Company employed at its South Chicago and Grand Crossing, Illinois, plants constitute a unit appropriate for the purposes of collective bargaining, within the meaning of Section 9 (b).of the National Labor Relations Act. 3. Bricklayers, Masons and Plasterers `International Union. of America, Local 21 of Illinois, has been designated and selected by a majority of the employees in the above unit as their representative for the purposes of collective bargaining, and is the exclusive repre- sentative of all the employees in -the said unit, within the meaning of Section 9 (a) of the National Labor Relations Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 704 DECISIONS- OF NATIONAL LABOR REI:ATIONS BOARD ,, IT IS HEREBY CERTIFIED that Bricklayers, Masons and Plasterers International Union of America, Local 21 of'Illinois, has been desig- nated and selected by a majority of all bricklayers employed at the South Chicago and Grand Crossing, Illinois, plants of Republic Steel Corporation, Cleveland, Ohio, as their representative for the purposes of collective bargaining, and that. pursuant to Section 9 (a) of the Act, Bricklayers, Masons and Plasterers International.. Union- of America, Local 21 of Illinois, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and, other conditions of employment.
