On November 30, 2011, the Board issued a Notice to Show Cause as to why the Charging Parties’ motions should not be granted pursuant to Section 102.48(d)(1) of the Board’s Rules and Regulations. Subsequently, Counsel for the Acting General Counsel filed a response indicating that he did not oppose the Charging Parties’ motions for 1 Local 135 was a charging party in Case Nos. 31-CA-27160 and 31-CA-27685, but not in Case No. 31-CA-27475. 2 reconsideration and to reopen the record. The Respondent did not file any response to the Notice to Show Cause. The Charging Parties’ October 8, 2010 motions for reconsideration and to reopen the record are granted. IT IS ORDERED, because Judge Lana H. Parke has retired, that this proceeding is remanded to Chief Administrative Law Judge Robert A. Giannasi, to designate another administrative law judge in accordance with Section 102.36 of the Board's Rules and Regulations. IT IS FURTHER ORDERED that the administrative law judge designated shall reopen the hearing on the matters raised in the motions, and prepare a supplemental decision setting forth findings of fact, conclusions of law, and a recommended Order. Copies of the supplemental decision shall be served on all parties, after which the provisions of Section 102.46 of the Board’s Rules and Regulations shall apply.
