C-54 and R-74 ORDER DISMISSING PETITION November 18, 1941 On August 24, 1939, the National Labor Relations Board issued a Decision, Order, and Direction of Election in the above-entitled case,' finding that Pilot Radio Corporation, New York City, herein called the respondent, had engaged in certain unfair labor practices, order- ing the respondent to cease and desist therefrom and to take certain affirmative action found necessary to effectuate the policies of the National Labor Relations Act, 49 Stat. 449, and directing that an election by secret ballot be conducted under the direction and super- vision of the Regional Director for the Second Region (New York City) among employees of the respondent. Pending compliance with the Board's order relating to the unfair labor practices, however, no date has been fixed for the election. In'view of the lapse of time since the issuance of said Decision, Order, and Direction of Election, we shall set aside the Direction of Election and dismiss the petition upon which the representation pro- ceeding is based.2 ORDER By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, and pursuant to National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY ORDERED that the Direction of Election issued in the above-entitled case on August 24, 1939, be, and it hereby is, vacated and set aside; AND IT IS FURTHER ORDERED that the petition for an investigation and certification of representatives of employees of Pilot Radio Cor- poration (New York City) filed on July 21, 1937, by United Electrical & Radio Workers of America, be, and it hereby is, dismissed. 114 N L It B 1084 a See Matter of J I Case Company and Fay m Equipment Workers Organizing Committee, etc, 36 N L R B , No 130 30N.L It B, No 213 1045 Copy with citationCopy as parenthetical citation
