DECISION AND CERTIFICATION OF,,7RE?RFSENTATIVES ,STATEMENT OF THE CASE Upon petition duly filed by Local Union No 12294 of the Gas By- Product Coke and Chemical Workers, United Mine Workers of Amer- ica, District No 50, affiliated with the C. I.0 .herein called the C. I.0 , alleging that a question affecting commerce had arisen conceinmg the representation of employees of the Palmer Match Company, herein called the Company, engaged in Akron, Ohio, in the manufacture, sale, and distribution of matches, the National Labor Relations Board provided for an appropriate hearing upon due notice On May 19, 1942, before a hearing was held, the Company, the C. I 0, United Match Workers Union No 18460, A F. of L, and the Regional Director for-the Eighth Region (Cleveland -Ohio,) entered into a "Stipulation for Certification on Consent Election," Pursuant to the stipulation, an election, by secret ballot was con- ducted on June 23, 1942, uirclel the direction and supervision of the Regional Dnectoi, among all production and maintenance employees employed by the Company in is Akron, Ohio, plant, including power- house employees, but excluding foienten, supervisors, and salaried and clei ical employees, to determine whether they desired to be represented by the C. I 0 or the A. F. L., or by neither. A question affecting commerce has arisen concerning the repre- sentation of employees of Palmer Match Company, Akron, Ohio, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act. - - 2 All production and maintenance employees employed by the Company in its Akron, Ohio, plant, including powerhouse employees, but excluding foremen, supervisors, and salaried and clerical em- ployees, constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 (b) of the Act 1 3'r Local Union No 12294 of the Gas By-Product Coke and Chemical Workers, United Mine Workers of America, District No 50, affiliated with the Congress of Industrial Organizations, has been designated and selected by a majority of the employees in the above unit as their representative for the purposes of collective bargaining and is the exclusive representative of all employees in said unit within the meaning of Sections 9 (a) of the Act CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested ui the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, IT 13 II.:REBY CERTIFIED that Local Union No 12294 of the Gas By- Product Coke and Chemical Workers, United Mine Workers of America, District No. 50, affiliated with the Congress of Industrial Or- ganizations, has been designated and selected by a majority of all production and maintenance employees employed by Palmer Match Company in its Akron, Ohio, plant, including powerhouse employees, PALMER MATCH COMPANY 439 but excluding foremen, super. visors, and salaried and clerical em- ployees, as their representative for the purposes of collective bargain- ing, and that, pursuant to Section 9, (a) of the Act, Local Union 'No. 12294,of`the Gas By-Product Coke and Chemical Workers, United Mine Workers of America, District No 50, affiliated with the Congress of Industrial Organizations, is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
