SUPPLEMENTAL FINDINGS OF FACT AND ORDER VACATING ORDER AND RECOMMENDATION On November 17, 1939, the National Labor Relations Board, herein called the Board, issued a Decision and Order in the above-entitled case.', Thereafter, on January 11, 1941, the Board petitioned the United States Circuit Court of Appeals for the Sixth Circuit, herein called the Court, for enforcement of its Order as provided in Section 10 (e) of the Act. III. The Respondent consents and agrees to the entry by the Court in No. 8863 National Labor Relations Board v. Newberry Lumber and Chemical Company 123 F (2nd) 831 (C. C. A. 6) of P supplementary decree vacating Paragraph 2 (c) and Paragraph 2 (d) of the Board's Order of November 17, 1939, in the above- captioned matter and substituting and enforcing the modified order as to these two paragraphs set forth above in Paragraph II, and the Respondent waives any right to contest an application by the Board for such supplementary decree and further waives notice of such application by the Board; IV. This Stipulation contains the entire agreement of the parties hereto and there is no verbal agreement of any kind which varies, alters, or adds to it; V. This Stipulation is subject to the approval of the Board and shall become effective upon the granting of the approval. .NEWBERRY LUMBER AND CHEMICAL COMPANY ' 51 On August 18, 1942, the Board issued its order approving the above stipulation and making it a part of the record in the case. ORDER AND RECOMMENDATION . Upon the basis of the above stipulation, dated August 6, 1942, and the entire record in the case, and pursuant to Section 10 (e) of the National Labor Relations Act, the National Labor Relations Board hereby vacates paragraph 2 (c) and paragraph 2 (d) of its Order, issued November 17,1939, and substitutes in lieu thereof the following numbered paragraphs,'and recommends to the United States. Circuit Court of Appeals for the Sixth Circuit that the Order of the Board be so modified and enforced as modified : 2.
