EMANUEL, MEMBER Dated, Washington, D.C., April 16, 2018. 1 We have treated the Employer’s “Request for Special Permission to Appeal” as a Request for Review. 2 The Employer’s attempt to avoid the Stipulated Election Agreement it voluntarily entered into is grounded in the Employer’s dissatisfaction with the voter-eligibility formula set forth in that agreement, not the appropriateness of the stipulated unit. Accordingly, even if the Board’s recent decision in PCC Structurals, 365 NLRB No. 160 (2017), would provide a basis for withdrawing from the stipulation – an issue we do not decide here – the Employer’s reliance on that case is misplaced. PCC addressed the standard for determining the appropriateness of a proposed bargaining unit. Neither PCC nor any other recent Board decision changed the standard for analyzing voter eligibility.
