requesting adverse judgment under 37 C.F.R. §41.127(b)(2). (Paper 15.) The
request is GRANTED.

Accordingly, it is
ORDERED that judgment on priority as to Count 1, the sole count of
the interference, is entered against Senior Party Zuker;
FURTHER ORDERED that claims 1, 4-6, 8-13, 15, 16, 21-23, and
26 of Zuker application 12/085,479, corresponding to Count 1 (Paper 1 at 3), are
FINALLY REFUSED, 35 U.S.C.§135(a);
FURTHER ORDERED that the parties note the requirements of 35
U.S.C. §135(c) and Bd.R. 205; and
FURTHER ORDERED that a copy of this judgment shall be entered
into the administrative record of the involved Zuker application and the involved
Matsunami patent.
