Case No. R-3815 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES July 30,1914 On May 19, 1912, the National Labor Relations Board issued a Decision and Direction of Election in the above-entitled proceeding.1 On June 24, 1942, the Board issued an Amendment to Direction of Election 2 Pursuant to the Direction of Election, as amended, an election by secret ballot was conducted on July 9, 1942, under the di- rection and supervision of the Regional Director for the Fourteenth Region (St Louis, Missouri). On July 10, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report on the ballot. On July 23, 1942, the Regional Director, acting pursu- 1 41 N L R B 497 2 41 N L R B 500 42NLRB,No210 472814-42--vol 42--73 1153 1154 DECISIONS OF NATIONAL LABOR RELATIONS BOARD ant to Article III, Section 9, of said Rules and Regulations, issued a Report on Objections recommending that the objections be overruled We have considered the objections of the Company and the Regional Director's report thereon, and find that the objections raise no material or substantial issues with respect to the conduct of the ballot. The objections are hereby overruled By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that United Mine Workers of America, Gas, Coke and Chemical Woikers, District No 50, affiliated with the Con- gress of Industrial Organizations, has been designated and selected by a majority of all employees at the three mines operated by Mahon- ing Mining Company in and near Cave-In-Rock, Illinois, excluding clerical and supervisory employees, guards, safety men, and the engi- neer, as their representative for the'purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, United Mine Workers of America, Gas, Coke and Chemical Workers, District No 50, affili- ated with the Congress of Industrial Organizations, is the exclusive representative of all such employees for the purposes of collective bar- gaining in respect to rates of, pay, wages, hours of employment, and other conditions of employment.
