DECISION AND CERTIFICATION, OF REPRESENTATIVES Upon petition duly filed,by United Steelworkers of. America, affili- ated with the-C. I. O:, herein called the Union, alleging that a ques- tion affecting commerce had arisen concerning the representation of employees of Lukens Steel Company and its subsidiaries, By-Products Steel Corporation and Lukenweld, Inc., herein called the Company, the National Labor Relations Board provided for an appropriate hearing upon due notice. On September 23, 1942, before a hearing was held, the Company, the Union, and the Regional Director for -the Fourth Region (Philadelphia, Pa.) entered into a "Stipulation for certification upon consent election." Pursuant to the stipulation, an election by secret ballot was con- ducted on October 1, 1942, under the direction and supervision of the Acting Regional 'Director, among all employees in the stipulated unit, to determine whether or not the said employees desired to be repre- sented by the Union for the purposes of collective bargaining. On October 5, 1942, the Acting Regional Director issued and duly served upon the parties an Election Report on the ballot. No objections to the conduct of the election or the Election Report have been filed by any of the parties. In his Election Report the Acting Regional Director reported as follows concerning the balloting and its results: Total on eligibility list____________________________________ 4, 261 Total ballots cast__________________________________________ 3,486 Total ballots challenged____________________________________ 11 44 N. FINDINGS OF FACT 1. A question affecting commerce has arisen concerning the repre- sentation of employees of Lukens Steel Company and its subsidiaries, By-Products Steel Corporation and Lukenweld, Incorporated, Coates- ville, Pennsylvania, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act. 2. All employees of the Companies' three plants at Coatesville, Pennsylvania, including the physical laboratory at Lukens Steel Com- pany, but exclusive of executives, foremen, assistant 'foremen, watch- men, police and fire guards, and employees belonging to the office forces, constitute a unit appropriate for the purposes of collective bargaining, within the meaning of Section 9 (b) of the Act. 3. United Steelworkers of America, affiliated with the C. 1., 0.!1 has been designated and selected by a majority of the employees in the above unit as their representative for the purposes of collective'bar- gaining and is the exclusive representative of all employees in said unit within the meaning of Section 9 (a) of the Act. CERTIFICATION OF REPRESENTATIVES By virtue of,and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act IT Is HEREBY CERTIFIED that United Steelworkers of America, affili- ated with the C. I. 0., has been designated and selected by a majority of all employees of the three plants of Lukens Steel Company and its subsidiaries By-Products Steel Corporation and Lukenweld, Incor- porated; at Coatesville, Pennsylvania, including the physical labora- tory at Lukens Steel Company, but exclusive of executives, foremen,, assistant foremen, watchmen, police and fire guards, and employees belonging to the office forces, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, United Steelworkers of America, affiliated with the C. 1. 0., is the exclusive representative of all such employees for the purposes of col- ]ectibe bargaining in respect to rates of pay, wages, hours of eniploy- ment and other conditions of employment.
