Case No. R-3405 CERTIFICATION OF REPRESENTATIVES • March 16, 1942 On January 27, 1942, the National Labor Relations Board issued its Decision and Direction of Election in the above-entitled proceed- ing. ) Pursuant to the Direction of Election, an election by secret ballot was conducted on February 25, 1942, under the direction and supervision of the Regional Director for the Second Region (New York City). On February 27, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued an Election Re- port, copies of which were duly served upon the parties. No objec- tions to the conduct of the ballot or to the Election Report were filed by any of the parties. B., No. 170. 870 LOEW'S INC. 871 of Industrial Organizations, has been designated and selected by a majority of all office, clerical, secretarial, and accounting employees employed at the home offices of Loew's Inc. and Marcus Loew Booking Agency, located at 1540 Broadway and 160 West 46th Street, New York City, but excluding executives, officers of the Companies, district managers, WHN radio salesmen, travelling auditors, lawyers, en- gineers, radio announcers and commentators, employees eligible to membership in labor organizations other than the Union, and em- ployees listed in Appendix "A", as their representative for the pur- poses of collective bargaining, and that, pursuant to the provisions of Section 9 (a) of the'National Labor Relations Act, Screen Office Professional Employees Guild, Local 109 of the U. O. P. W. All affiliated with the Congress of Industrial Organizations, is the exclu- sive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
