We note that Region 15 i ssued a complaint in Case 15 -CA- 193 5 7 on March 31, 2010, alleging that the Employer violated Sec. 8(a)(5) and (1) of the National Labor Relations Act by refusing to bargain for a successor collective-bargaining agreement and by failing to remit dues. Member Schaumber agrees that the Regional Director's disposition of the petition was consistent with extant precedent. However, he questions, given the facts of this case, whether it would not be more sensible and expeditious to simply conduct the election and let the employees decide who their representative should be going forward.
