GRIFFIN, JR., MEMBER SHARON BLOCK, MEMBER Dated, Washington, D.C., November 27, 2012 1 Although we find that the Regional Director did not abuse her discretion in approving withdrawal of the petition without prejudice, we certainly do not condone the Petitioner’s conduct. Indeed, the Petitioner should take note that it would have been well within the Regional Director’s discretion to impose sanctions based on the Petitioner’s conduct. In that respect, we note that the Employer did not request review of the Regional Director’s denial of its request that the Petitioner be ordered to reimburse it for its expenses related to the hearing, including counsel’s travel expenses.
