Kinney Iron WorksDownload PDFNational Labor Relations Board - Board DecisionsAug 28, 194243 N.L.R.B. 788 (N.L.R.B. 1942) Copy Citation In the Matter of KINNEY IRON WORDS and KINNEY IRON WORKS DIvI- SION, LOCAL 2018, UNITED STEELWORKERS OF AMERICA Case No. R-4013 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES August R8,1942 On July 23, 1942, the National Labor Relations Board issued a, Deci- sion and Direction of Elections in the above -entitled proceeding.1 In its Decision and Direction , of Elections , the Board provided that elections by secret ballot be conducted as early as possible, but not later than thirty '(30) days from the date of the Direction, under the supervision and direction of the Regional Director for the Twenty- first Region among those employees of Kinney Iron Works, Vernon, California , who fall within the groups described below : (a) All pattern makers and apprentices of the Company , to deter- mine whether they desired to be represented by Pattern Maker 's Asso- ciation of Los Angeles , affiliated with the American Federation of Labor, or by Kinney Iron Works Division , Local 2018 , United Steel- workers of America , affiliated with the Congress of Industrial Organi- zations, for the purposes of collective bargaining , or by neither; and (b) All production and maintenance employees of the Company, excluding watchmen, truck . drivers, metallurgists , shipping clerks, office and clerical employees ,• supervisor- s having authority to hire and discharge , working foremen , and -pattern makers and apprentices, to determine whether or not they desired to be represented by Kinney Iron Works Division , Local 2018 , United Steelworkers of America, affiliated with the Congress of Industrial Organizations , for the pur- poses of collective bargaining. Pursuant to the Direction of Elections , elections by secret ballot were conducted on August 12, 1942, under the direction and super- vision of the Regional Director for the Twenty-first Region (Los Angeles, California ). On August 13, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations 1 42 N. L R B. 838 43 N. L. It. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. The Board stated that if they chose the same representatives as the employees in the industrial unit, they would together constitute an appropriate unit. If they chose differ- tnt representatives, they would then constitute separate appropriate units. . We find that all pattern makers and apprentices of the Company constitute a unit appropriate for the purposes of collective bargain- ing, within the meaning of Section 9 (b) of the Act. We further find that all production and maintenance employees of the Company, excluding watchmen, truck drivers, metallurgists, 796 DECISIONS OF NATIONAL LABOR RELATIONS BOARD shipping clerks, office and clerical employees , supervisors having the authority to hire and discharge , working foremen , and pattern makers and apprentices , constitute, a unit , appropriate for the purposes of collective bargaining , within the meaning of Section 9 (b) of the Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that Pattern Makers Association of Los Angeles , affiliated with the American Federation of Labor, has been designated and selected by a majority of all ' pattern makers and ap- prentices of Kinney Iron Works, Vernon, California , as their rep- resentative for the purposes of collective bargaining, and that, pur- suant to Section 9 (a) of the Act , Pattern Makers Association of Los Angeles , affiliated with the American Federation of, Labor, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages , hours of em ployment , and other conditions of employment. IT IS HEREBY CERTIFIED that Kinney Iron Works Division, Local 2018, United Steelworkers of America , affiliated with the Congress of Industrial Organizations , has been designated and selected by a majority of all production and maintenance employees of Kinney Iron Works , Vernon, California , excluding watchmen , truck drivers, metallurgists , shipping clerks, office and clerical employees , super- visors having the authority to hire and discharge, working foremen, and pattern makers and apprentices , as their representative for the purposes of collective bargaining , and that, pursuant to Section 9 (a) of the Act , Kinney Iron Works Division , Local 2018 , United Steel- workers of America, affiliated with the Congress of Industrial Organi- zations, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment , and other conditions of employment.
