R-1611 and R-1612 CERTIFICATION OF REPRESENTATIVES July 15, 1940 On May 24, 1940, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Elections 1 in the above entitled proceeding. On June 10, 1940; the Board issued an Amendment, to Direction of Elections.' Pursuant to the Direction of Elections, as amended, elections by secret ballot Were conducted by nail, under the direction and supervision of the Regional Director for the Second Region (New York City). The deadline for the return of the ballots was set for midnight, June 23, 1940, and the ballots were opened on June 28, 1940. On July 1, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and R3gnlations-Series 2, as amended, issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. As to the balloting and its results, the Regional Director reported as follows : 1. I. 0., has been designated and selected by a majority of all employees in the International News Photos Division of King Features Syndicate, Inc., New York City, excluding the editor, the sales manager, tipsters, and employees who are stationed in foreign countries, as their representative for the purposes of collective bar- gaining, and that, pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, American Newspaper Guild, affiliated with the C. I. 0., is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment; and IT Is HEREBY CERTIFIED that Kingsyn Employees Association has been designated and selected by a majority of all employees in the Features Division of King Features Syndicate, Inc., New York City, excluding officers of the Company, supervisory employees having the power to make recommendations concerning the hire and discharge of employees, all persons employed in the Central Press Association, a department of the Company in Cleveland, Ohio, employees who are members of or eligible to membership in craft organizations having contracts with the Company, and employees stationed in foreign countries, as their representative for the purposes of collective bar- gaining, and that, pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, Kingsyn Employees Association is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
