DECISION AND CERTIFICATION OF REPRESENTATIVE
The National Labor Relations Board, by a three-member panel,1 has considered
objections to an election held January 5 and 7, 2011, and the Regional Director’s report
recommending disposition of them.2 The election was conducted pursuant to a Stipulated
Election Agreement. The tally of ballots shows 46 for Petitioner, 25 for Intervenor, and 0
against representation, with no challenged ballots.
The Board has reviewed the record in light of the exceptions and briefs, has
adopted the Regional Director’s findings and recommendations, and finds that a
certification of representative should be issued.

1 Member Becker is recused and did not participate in the consideration of this
case.
2 The Regional Director approved the Intervenor’s request to withdraw its
Objections 7 and 13.

CERTIFICATION OF REPRESENTATIVE
IT IS CERTIFIED that a majority of the valid ballots have been cast for National
Union of Healthcare Workers, and it is the exclusive collective-bargaining representative
of the employees in the following appropriate unit:
All full-time and regular part-time CNAs, LVNs, Unit Clerks,
Housekeeping Aides, Dietary Aides, and Cooks employed by the
Employer at its San Leandro, California facility; excluding all stationary
engineers, all managerial, technical, confidential, and professional
employees, all other employees, guards, and supervisors as defined in the
Act.
