Employer and INTERNATIONAL BROTHERHOOD OF TEAMSTERS, LOCAL 966 Petitioner Case 22-RC-099498 DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board has considered objections to an election held April 19, 2013, and the Acting Regional Director's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 67 ballots cast for and 42 ballots cast against the Petitioner, with 7 challenged ballots, an insufficient number to affect the results. The Employer timely filed exceptions to the Acting Regional Director’s Report on Objections. On December 9, 2013, the Employer withdrew its Exceptions to the Acting Regional Director’s Report. The Employer’s withdrawal of its Exceptions is hereby approved. Accordingly, as there are no exceptions pending before the Board and the time allowed for such filing having expired, the Board adopts the Acting Regional Director's findings and recommendations, and finds that a certification of representative should be issued. 2 CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for International Brotherhood of Teamsters, Local 966, and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All full time and regular part time bus drivers and aides employed by the Employer at its 7061 Route 35 South, South Amboy, New Jersey facility, but excluding all office clerical employees, dispatchers, safety trainers, professional employees, temporary employees, casual employees, maintenance employees, yard men/women, guards and supervisors as defined in the Act, and all other employees.
