Sep. 19, 2012) Copy Citation NOT INCLUDED PGB IN BOUND VOLUMES Washington, DC UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD INTERNATIONAL BROTHERHOOD OF TEAMSTERS, AFL-CIO Employer and Case 05-RC-078154 FEDERATION OF AGENTS AND INTERNATIONAL REPRESENTATIVES (FAIR) Petitioner DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board, by a three-member panel, has considered objections to a mail ballot election, in which the ballots were mailed to voters on May 14, 2012, and counted on May 29, 2012, and the Regional Director’s report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 18 for and 16 against the Petitioner, with one challenged ballot, an insufficient number to affect results. The Board has reviewed the record in light of the Employer’s exceptions and brief, has adopted the Regional Director’s findings and recommendations, and finds that a certification of representative should be issued. CERTIFICATION OF REPRESENTATIVE It is certified that a majority of the valid ballots have been cast for the Federation of Agents and International Representatives (FAIR), and that it is the exclusive collective- bargaining representative of the employees in the following appropriate unit: All full-time International Organizers employed by the Employer, but excluding all project officers, office clerical employees, professional employees, guards, and supervisors as defined in the Act. Dated, Washington, D.C., September 19, 2012. _________________________________ Mark Gaston Pearce, Chairman _________________________________ Richard F.
