ORDER DENYING MOTION
The Respondent’s motion to dismiss the claims raised in the consolidated
complaint’s paragraphs 4(b), 4(c), 4(k), and 4(h) is denied. On January 19, 2018, the
Region issued an amendment to the consolidated complaint which deleted certain of the
allegations at issue in the Respondent’s motion. Regarding the remaining allegations in
the consolidated complaint, the Respondent has failed to establish that there are no
genuine issues of material fact warranting a hearing and that it is entitled to judgment as
a matter of law.
