Illinois Electric Porcelain Co.Download PDFNational Labor Relations Board - Board DecisionsAug 23, 194134 N.L.R.B. 858 (N.L.R.B. 1941) Copy Citation In the Matter of ILLINOIS ELECTRIC PORCELAIN COMPANY and ILLINOIS ELECTRIC PORCELAIN WORKERS OF MACOMB FEDERAL LABOR UNION No. 21787, AFFILIATED WITH THE AMERICAN FEDERATION OF LABOR Cases No. C-1312 and R-1333 DIRECTION OF ELECTION August 03, 1941 On April 19, 1941, the National Labor Relations Board, herein called the Board, issued a Decision and Order 1 in the above-entitled proceedings, ordering that the respondent cease and desist from cer- tain unfair labor practices and take certain affirmative action found necessary- to effectuate the policies of the National Labor Relations Act, 49 Stat. 449, and therein stating that an election by secret ballot would be directed among certain employees of the respondent upon receipt of information from the Regional Director that the circum- stances permit a free choice of representatives unaffected by the re-, spondent's unlawful acts. By letter dated August 8, 1941, the Regional Director informed the Board that in his opinion the circumstances permit a free choice of representatives unaffected by the respondent's unlawful acts, and en- closed with that letter a motion filed, on the same date, by counsel for Illinois Electric Porcelain Workers of Macomb, Federal Labor Union No. 21787, affiliated with the A. F. of L., stating that that union had been succeeded by the National Brotherhood of Operative Potters, Local 176, and requesting that the National Brotherhood of Opera- tive Potters, Local 176, be substituted of record for the Illinois Electric Porcelain Workers of Macomb, Federal Labor Union No. 21787, affili- ated with the American Federation of Labor, and further requesting that the Board issue its Direction of Election in this proceeding and that the ballot bear the name of the National Brotherhood of Potters, Local 176, in place and in the stead of Illinois Electric Porcelain Workers of Macomb, Federal Labor Union, No. 21787, affiliated with the American Federation of Labor. B., No. 104. 858 ILLINOIS ELECTRIC PROCELAIN COMPANY 859 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Section 8, of National Labor Relations Board Rules and Regulations-Series 2, as amended, it is hereby DIRECTED that, as part of the investigation authorized by the Board to ascertain representatives for the purpose of collective bargaining with the Illinois Electric Porcelain Company, Macomb, Illinois, an election by secret ballot shall be conducted as early as possible but not later than thirty (30) days from the'date of this Direction-of Election under the direction and supervision of the Regional Director for the Thirteenth Region, acting in this matter as agent for the National Labor Relations Board and subject to Article III, Section 9, of said rules and regulations, among all the employees of the Illinois Electric Porcelain Company, Macomb, Illinois, whose names appear on the Company's pay roll immediately preceding the date of this Direction of Election, including any employees who did not work during said pay-roll period because they were ill or on vacation or absent because called for military service and employees who were then or have since been temporarily laid off, but excluding officers, office employees, cleri- cal employees, superintendents, foremen, assistant foremen, watch- men, and salesmen, and employees who have since quit or been dis- charged for cause, to determine whether or not they desire to be repre- sented for the purpose of collective bargaining by the National Broth- erhood of Operative Potters, Local 176, affiliated with the American Federation of Labor.
