The Respondent’s partial motions to dismiss the claims raised in the second
consolidated complaint’s paragraphs 6(i), 6(j), and 6(k), or in the alternative, motions for
summary judgment, are denied. The Respondent has failed to establish that there are
no genuine issues of material fact warranting a hearing and that it is entitled to judgment
as a matter of law.
