Pursuant to the Direction of Elec- tion, an election by secret ballot was conducted on' April 11, 1941, under the direction and supervision of the 'Regional Director for the Seventh Region (Detroit, Michigan). On April 17, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued ail Election Report, copies of which were duly served upon the parties. As to the balloting and its results, the Regional Director reported as follows : Total on eligibility list------------------------------------- 503 Total ballots cast.----------------------------------------- 470 Total ballots challenged------------------------------------ 8 Total blank ballots----------------------------------------- 0 Total void ballots------------------------------------------ 0 Total valid votes cast -------------------------------------- 462 Votes cast for Local 701, International Union, United Automo- bile Workers of America, C. I. 0-------------------------- 224 Votes cast for Local 663, International Union, United Automo- bile Workers of America, A. F. of L--------------------- 233 Votes cast for neither-------------------------------------- 5 The Regional Director reported further : Inasmuch as neither union received a majority of the votes cast and the challenged ballots thereby became pertinent, it was necessary to make a determination of the challenges. 1 30 N L. B., No 124. 746 HILLSDALE STEEL PRODUCTS COMPANY 747 On April 15, 1941, the challenges in question were opened and the ballots counted in the presence of representatives of each of the interested parties. There were 8 challenged ballots. Four of the persons were found to be ineligible because investigation showed they were supervisory employees. The remaining 4 ballots were found to be ballots of persons eligible within the definition of the eligibility clause of the Board's Direction of Election. These 4 ballots were counted as follows : Votes cast for Local 701, International Union, United Automo- bile Workers of America, C. I. 0.-------------------------- 1 Votes cast for Local 663, International Union, United Auto- mobile Workers of America, A. F. of L ---------------------- 236 Votes cast for neither -------------------------------------- 5 On April 23, 1941, Local 701, international Union, United Auto- mobile Workers of America, affiliated with the Congress of In- dustrial Organizations, herein called Local 701, filed with the Regional Director Objections to the Election Report. On April 29, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties his Report on, Objections stating that the Objections should be overruled and recommending that the Board find that the-Objections raise no sub- stantial or material issue. The Board has considered the Objections to the Election Report and the Regional Director's Report on Objections and finds that the Objections to the Election Report raise no substantial or material issues with respect to the conduct of the ballot or the Election Re- port. The Objections are hereby overruled. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations- Series 2, as amended, 748 DECISIONS OF NATIONAL LABOR RELATIONS BOARD IT is HEREBY CERTIFIED that Local 663, International Union, United Automobile Workers of, America, affiliated with the American Fed- eration of Labor, has been designated and selected by a majority of the production and maintenance employees of Hillsdale Steel Prod- ucts Company, Hillsdale, Michigan, including inspectors and em- ployees of the drafting and tool design department, but excluding watchmen, timekeepers, office force, and supervisory employees, as their representative for the, purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, Local 663, International Union, United Automobile Workers of America, affiliated with the American Federation of Labor, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
