On June 24, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regu- lations-Series 2, as amended, issued and duly served upon the parties an Election Report No objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. As to the balloting and its results, the Regional Director reported as follows Toolrooni employees Total on eligibility list------------------------------------- 14 Total ballots cast------------------------------------------ 13 Total ballots challenged------------------------------------- 0 Total blank ballots----------------------------------------- 0 Total void ballots___________________________________________ 0 Total valid votes counted------------------------------------ 13 Votes cast foi International Association of Machinists, Lodge 340------------------------------------------------------ 12 Votes cast for Independent Rotary Union-------------------- 0 Votes cast for neither union--------------------------------- 1 1 41N L R B 615 42NLRB,No69 299 300 DECISIONS OF NATIONAL LABOR RELATIONS BOARD Remaining production and maintenance employees Total on eligibility list -------------------------------------- 214 Total ballots cast------------------------------------------- 1,56 Total ballots challenged---------'-------------------------- 7 Total blank ballots ----------------------------------------- 0 Total cold ballots- ----------------------------------------- 0 Total valid Notes counted ----------------------------------- 156 Votes cast foi United ' Electiical , Radio & Maclaine Woikeis of America, CIO-------------------------------------- L ------ 139 Votes cast for Independent Rotary Union-- ------------------- 13 Votes east for neither union----- ---- ,----------------------- 4 In the Decision and Direction of Elections pieviously referred to, the Board made no final determination as to the appropiiate unit or units but found that the toolroom employees "could pioperly con- stitute a sepaiate unit or be included with production and mainte- nance employees as part of a larger unit," depending upon the iesults of the elections directed by the Board Upon the entire record in the case, the Boaid makes the following SUPPLEMENTAL FINDINGS OF FACT We find that all tool and die makers, mechanical maintenance men, and apprentices employed in the Company's toolroom, excluding the foreman, constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 (b) of the Act We also find that all -production and maintenance employees of .the Company, excluding foremen, executives, supervisory and office employees, and tool and die makers, mechanical maintenance men, and, apprentices employed in the toolroom, constitute a unit appro- priate for the purposes of collective bargaining within the -meaning of Section 9 (b) of the Act CERTIFICATION OF, REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat 449, and pursuant to AI title III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that International Association of Machinists, Lodge 340, has been designated and selected by a majoiity of all tool and die makers, mechanical maintenance men, and apprentices employed in the took oom of Henry L Crowley & Co, Inc, West Orange, New Jersey, excluding the foreman, as their iepiesentatives for the purposes of collective bargaining, and that, pursuant to Sec- tion 9 (a) of the National Labor Relations Act, International- Asso- ciation of Machinists, Lodge 340, is the exclusive representative of HENRY L CROWLEY & CO, INC. 301 all such employee-, for the purposes of collective bargaining in respect to rates of pay, wages, hoots of employment, and other conditions of employment IT IS FURTHER CERTIFIED that United Electrical, Radio & Machine Workers of America, affiliated with the Congress of Industrial Or- ganizations, has been designated and selected by ti majority of all production and maintenance employees of Henry L Crowley & Co, Inc, West Orange, New Jersey, excluding foietnen, executives, super- visory and office employees, and tool and die makers, mechanical maintenance men, and apprentices employed 'in the toolroom, as their representative for the purposes of collective bargaining, and that, puisuant to Section 9 (a) of the National Labor Relations Act, United Electrical, Radio & Machine Workers of America, affiliated with the Congress of Industrial Organizations, is the exclusive rep- sentative of all such employees for the purposes of collective bar- gaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
