Gulf Oil Corp.Download PDFNational Labor Relations Board - Board DecisionsJul 27, 194242 N.L.R.B. 938 (N.L.R.B. 1942) Copy Citation In the Matter of GULF OIL CORPORATION , MARINE DEPARIMENT and NATIONAL MARITIME UNION, C I 0 Case No R-3035 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES July 27,194,9 On November 17, 1941, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding,' in which it found that the unlicensed per- sonnel employed by the Gulf Oil Corporation, Maisie Depaitment, New York City, herein called the Company, on its vessels Regent and Paratex, which had been operating principally on the Great Lakes, constituted a unit appropriate for the purposes of collective bargain- ing, and ordered an election among such employees Since the issuance of said Decision, the Regent has ceased to operate on the Great Lakes. On March 14, 1942, the Regional Director for the Eighth Region (Cleveland, Ohio), acting pursuant to Aiticle III, Section 9, of National Labor" Relations Boai d Rules and Regulations-Series 2, as amended, issued an Election Report, copies of which were duly served upon the parties The Regional Director reported that, pursuant to the Direction of Election, an election by secret ballot was conducted under his direction and supervision on December 10, 1941, among the eligible employees on the Paratex, but that he had been unable to conduct the election on the Regent. As to the balloting on the Paratex and its results, the Regional Director reported as follows: Total on eligibility list______________________________________ 11 Total ballots cast___________________________________________ 11 Total ballots challenged_____________________________________ 0 Total blank ballots__________________________________________ 0 Total void ballots___________________________________________ 0 Total valid votes cast ---------------------------------------- 11 Votes cast for National Maritime Union, C I 0______________ 9 Votes cast against National Maritime Union, C I 0----------- - 2 1 36 N L R B 1003 42NLRB,No177 938 GULF OIL CORPORATION 939 No objections to the Election Report have been filed by any of the parties However, on March 18, 1942, the Company filed a written request with the Board urging that, since the Regent has ceased to - operate on the Great Lakes and none of the employees on that vessel has voted , the National Maritime Union, affiliated with the Corigiess of Industrial Organizations, herein called the N M. U, should not be certified as bargaining representative for the unlicensed personnel on the Regent . On or about June 16, 1942, the parties entered into a stipulation agreeing that the unlicensed personnel or the Paratex constitute an appropriate unit for the purposes of collective bargaining and that the N. M U may be certified as the exclusive bargaining representative of such employees The Board hereby approves the stipulation and shall include only the unlicensed personnel on the Paratex in the unit for which the N M U is certified below. CERTIFICATION OF REPRESENTATIVES By 'virtue of and pursuant to the power vested in the 'National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat 449 , and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY crRTIFIED that National Maritime Union, affiliated with the Congress of Industrial Organizations , has been designated and selected by a majority of all unlicensed personnel employed by Gulf Oil Corporation , Marine Department , on its vessel Paratex, as their representative for the purposes of collective bargaining, and that, pur- suant to Section 9 (a) of the National Labor Relations Act, National Maritime Union, affiliated with the Congress of Industrial Organiza- tions, is the exclusive repiesentative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment , and other conditions of employment y Copy with citationCopy as parenthetical citation
