OF L.) - Case No. R-4099 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES October 3, 194 On August 28, 1942, the National Labor Relations Board issued a Decision and Direction of Election in the above -entitled proceed- ing.' Pursuant to the Direction of Election , an election by secret ballot was conducted on September 15, 1942, under the direction and supervision of the Regional Director for the First Region (Bos- ton, Massachusetts ). On September 16, 1942, the Regional Director, acting pursuant . to Article III, Section 9, of National Labor Rela- tions Board Rules and Regulations-Series 2, as amended, , issued and duly' served upon the parties his Election Report. 'As to the balloting and its results, the Regional Director reported as follows : Total number eligible to vote-------------------------------- 21 Total number of votes cast--------------------------------- 19 Total number of valid votes-------------------------------- 19 Total number of ballots cast for Heel Makers Federal Labor Union No. 22714------------------------------------------ 18 Total number- of ballots cast against Heel Makers Federal Labor Union No 22714------------------------------------ 1 Total number of blank ballots------------------------------ 0 Total number of void ballots-------------------------------- 0 Total number of challenged ballots------------------------- 0 On September 18, 1942, the Company filed objections to the elec- tion. On September 21, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations=Series 2, as amended, issued a report in which he found the objections to be without merit. 343N.L R B 752. 44 N. L. R. B., No. 151. 792 GREENWAY WOOD HEEL CO., INC. 793 The Company claims in its objections that "all of the Employees of the S. & L. Wood Heel Company should have participated in the voting at this election instead of just the Turning' Plant." The Company further claims "that - the law requires that voting booths should have been used for this election." The Company's first objection relates not to the election but rather to the Board's 'decision wherein the appropriate unit was established contrary to the Company's contention . So far as the other objection is concerned , it appears from the Regional Director 's Report on Objections that "since there were but 21 employees on- the eligibility list, no booths were used but each voter had an opportunity to vote in strict privacy." - . ' We find that the objections raise no substantial or material issues with respect to the conduct of the" ballot or the Election Report. Accordingly, the objections are hereby overruled. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations , Board Rules and Regulations-Series 2, as amended, IT Is HEREBY CERTIFIED that Heel Makers Federal Labor Union, No. 22714 (A. F. of L.) has been designated and selected by a ma- jority' of all employees of Silver J. Lalumiere , Mary M. Lyons, and Henry J. Lalumiere , doing business under the name and style of S. & L. Wood Heel Company, Methuen, Massachusetts , in the Wood Heel Turning Department , excluding supervisory employees , as their rep- - resentative for the purposes of collective bargaining , and that, -pur- suant to the - provisions of Section 9 (a) of ' the Act, Heel Makers Federal Labor Union , No. 22714 (A. F. of L.) is the exclusive repre- sentative of all such employees for the purposes of collective bargain- ing in respect to rates of pay, wages , hours of employment , and other conditions of employment.
