Feb. 9, 2015) Copy Citation Irvington, NJ UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD GRAND MEDICAL TRANSPORTATION LLC Employer and MED-LIFE M&M CONSULTANCY Petitioner Case 22-RC-140821 DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board has considered objections to a secret-ballot election held December 11, 2014, and the Acting Regional Director's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 10 ballots cast for the Petitioner and 5 ballots cast against the participating labor organizations, with 1 void ballot and 4 challenged ballots, an insufficient number to affect the results. No exceptions have been filed to the Acting Regional Director's report within the time provided. Accordingly, the Board adopts the Acting Regional Director's findings and recommendations, and finds that a certification of representative should be issued.1 1 The Employer alleges in Objection 1 that the Petitioner improperly designated its President, Eric McLemore, to serve as its election observer at the December 11 election. In Objection 2, the Employer alleges that on the day of the election while the election was being conducted, certain former employees of the Employer were permitted onto its premises and into the voting location to cast ballots, and that the foregoing created a “hostile work environment” that interfered with the December 11 election. The Acting Regional Director recommended that the Employer’s objections be overruled. 2 CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for Med-Life M&M Consultancy and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All full-time and regular part-time Emergency Medical Technicians employed by the Employer at its Irvington, New Jersey facility, who were employed by the Employer during the payroll period ending Saturday, November 8, 2014.
