DECISION AND CERTIFICATION OF REPRESENTATIVE
The National Labor Relations Board has considered an objection to an election held
June 10, 2010, and the Regional Director's report recommending disposition of it. The election
was conducted pursuant to a Stipulated Election Agreement. The corrected tally of ballots
shows 9 ballots cast for and 8 ballots cast against the Petitioner. There were no challenged
ballots.
No exceptions have been filed to the Regional Director's report within the time provided.
Accordingly, the Board adopts the Regional Director's findings and recommendations, and finds
that a certification of representative should be issued.
CERTIFICATION OF REPRESENTATIVE
IT IS CERTIFIED that a majority of the valid ballots have been cast for Teamsters Local
Union No. 538 Affiliated with the International Brotherhood of Teamsters and that it is the
exclusive collective-bargaining representative of the employees in the following appropriate unit:
All full-time and regular part-time warehouse employees, maintenance
employees, dispatch employees and shipping and receiving employees
employed by the Employer at its Cranberry Township, Pennsylvania, facility;
excluding all office clerical employees and guards, professional employees and
supervisors as defined in the Act, and all other employees.
