F. L. Case No. R-4042 SUPPLEMENTAL DECISION AND CERTIFICATION OFD REPRESENTATIVES September 08, 194.. On August 5, 1942, the National Labor Relations Board issued a Decision and Direction of Election in the above-entitled proceeding,' directing that an election by secret ballot be conducted among all shovel, dragline, crane, and tractor operators in the transportation department of General Petroleum Corporation of California, em- ployed in the Bakersfield, Ventura, and Los Angeles, California, areas. Pursuant to the Direction of Election, an election by secret ballot was conducted under the direction and supervision of the Regional Director for the Twenty-first Region (Los Angeles, California). On September 5, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, as amended, issued and -duly served upon the parties an Election Report. No objections to the conduct of.the ballot or the Election Report have been filed by any of the parties. The Board stated that if a majority of the eligible voters cast their votes for Interna- tional Union of Operating Engineers, Local 12, A. F. of L., all those eligible to vote would constitute a separate bargaining unit. If, how- ever, a majority of those voting cast their ballots for Employees Union of General Petroleum Corporation of California or for neither union, the eligible employees would not constitute a bargaining unit separate from other employees of the Company. Upon the basis, of the entire record,'the Board makes the following : SUPPLEMENTAL FINDINGS OF FACT We find that all shovel, dragline, crane, and tractor operators in the transportation department of General Petroleum Corporation of California, employed in the Bakersfield, Ventura, and Los Angeles, California, areas constitute a unit appropriate for the purposes of collective bargaining, within the meaning of Section 9 (b) of the National Labor Relations Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that International Union of Operating Engi- neers, Local 12, affiliated with the American Federation of Libor, has been designated and selected by a majority of all shovel, dragline, crane, and tractor operators in the transportation department of Gen- eral Petroleum Corporation of California, employed in the Bakers-' field, Ventura, and Los Angeles, California, areas, as their representa- tive for the purposes of collective bargaining, and that pursuant to Section 9 (a) of the Act, International Union of Operating Engi- neers, Local 12, affiliated with the American Federation of Labor, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of em- ployment, and other conditions of employment.
