Case No. R-3943 SUPPLEMENTAL DECISION AND DIRECTION OF RUN-OFF ELECTION Septe'kber 3, 1942 On July 15, 1942, the National Labor Relations Board, herein called the Board; issued a Decision and Direction of Election in'the above- entitled proceeding., Pursuant to the Direction of Election, an elec- tion by secret ballot was conducted on August' 12, 1942, under the direction and supervision.of the Regional Director for the Eleventh Region (Indianapolis, Indiana). On August 18, 1942, the Regional, Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties his Election Report.. In accordance with a stipulation of the parties entered into pursuant to United States Army Regulations, the Regional Director reported the results of the Election in percentages instead of the usual form 'setting forth the number of persons eligible to vote and the number who partici- pated iii the balloting. No objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. As to the balloting and its results, the Regional-Director reported as follows : Percent Valid votes cast for International Union, United Automobile Workers of America, Local No 683, affiliated with the A F. of L, and Local B-1194 of the International Brothei hood of Electrical Workers, affiliated with the A F of L, jointly___ 46 69' Valid votes cast for International Union, United Automobile, Aircraft, and Agricultural Implement Workers of America, Local No 292, affiliated with the C I O-------------------- 47. 18 Votes cast for neither______________________________________ 6.13 On August 14, 1942, International Union, United Automobile, Air- craft, and Agricultural Implement Workers of America, Local No. 292, affiliated with the C. I. O.,,filed a request for a-run-off election to be held by the Board. . Accord- ingly, we shall direct a run-off election in which such employees will be given an opportunity to decide whether they desire to be repre- sented by International Union, United.Automobile, Aircraft, and Ag- ricultural Implement Workers of America, Local No. 292, affiliated with the Congress of Industrial Organizations, or jointly by Inter- national Union, United Automobile Workers of America, Local No. 683, and 'Local B-1194 of, the; International Brotherhood of Electrical Workers, both affiliated with the American Federation of Labor, for the purposes of collective bargaining. DIRECTION OF RUN=OFF ELECTION By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act`, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, it is hereby DIRECTED that, as part of the investigation authorized by the Board to determine representatives for the purposes of collective bargaining with Delco Radio Division of General Motors Corporation, Kokomo, Indiana, an election by secret ballot shall be conducted as early as possible, but not,later than thirty (30) days from the date of this Direction of Run-Off Election,, under the direction and supervision of the Regional Director for the Eleventh- Region, actin in this matter as agent for the National Labor Relations Board and subject to Article III, Section 9, of said Rules and Regulations, among all employees of Delco Radio Division of General Motors Corporation, Kokomo, Indiana, in the appropriate unit described in the Decision and Direction' of, Election issued July •15, • 1942, who were employed during the pay-roll period immediately preceding. said Decision and Direction of Election, but excluding those who have since quit or been discharged for cause, to determine whether they desire to be repre- sented by International Union, United Automobile, Aircraft, and Agricultural Implement Workers of America, Local No. 292, affiliated, with the" Congress of Industrial Organizations, or jointly by Interna- tional Union, United Automobile Workers of America, Local No. 683, and Local B-1194 of the International Brotherhood of Electrical Workers, both affiliated with the American Federation of Labor, for the purposes of collective bargaining: CHAIRMAN MILLIS took no part in the consideration of the above Supplemental Decision and Direction-of Run-off Election. 1 Copy with citationCopy as parenthetical citation
