DECISION - AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE Upon petition duly filed by United Organization of Plant Pro- tection Employees, herein called the Independent, alleging that a question affecting commerce had arisen concerning the representation of employees of'General Motors Corporation, Fisher Body Division (Flint Plant #1), herein called the Company, engaged at Detroit, Michigan, in the manufacture and assembly of automobile bodies and parts, the National Labor Relations Board provided for an appro- priate hearing upon due notice. On April 16, 1942, before a hearing was held, the Company, the Independent, and the Regional Director for the Seventh Region (Detroit, Michigan) entered into a "Stipula- tion for Certification on Consent Election." Pursuant to the Stipulation, an election by secret ballot was con- ducted on May 6, 1942, under the direction and supervision of the Regional Director, among all plant protection employees of the Com- pany, excluding sergeants, lieutenants, captains, chiefs, and other supervisory employees and clerical employees, to determine whether or not they desired to be represented by the Independent. On May 8, 1942, the Regional Director issued and duly served upon the parties 41 N. L R B., No. 69. 320 GENERAL MOTORS CORPORATION 321 an Election Report on the ballot. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. A question affecting commerce has arisen concerning the repre- sentation of employees of General Motors Corporation, Fisher Body Division (Flint Plant #1), Detroit, Michigan, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act. 2. All plant protection employees of the General Motors Corpora- tion, Fisher Body Division (Flint Plant #1), Detroit, Michigan, excluding sergeants, lieutenants, captains, chiefs, and other super- visory employees and clerical employees, constitute a unit appropriate for the purposes of collective bargaining within the meaning of - Section 9 (b) of the Act. 3. United Organization of Plant Protection Employees has been designated and selected by a majority of employees in the above unit as their representative for the purposes of collective bargaining and is the exclusive representative of all employees in said unit within the meaning of Section 9 (a) of the Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Re- lations Act, IT IS HEREBY CERTIFIED that United Organization of Plant Protec- tion Employees has been designated and selected by a majority of all plant protection employees of the General Motors Corporation, Fisher Body Division (Flint Plant #1), Detroit, Michigan, excluding ser- 463892-42-vol. 41-21 322 DECISIONS OF NATIONAL LABOR RELATIONS BOARD geants, lieutenants, captains, chiefs, and other supervisory employees and clerical employees, as their representative for the purposes, of collective bargaining, and that, pursuant to Section 9 (a) of the Act, United Organization of Plant Protection Employees is the ex- clusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
