1 The Petitioner contends that the current Board lacks authority to decide the request for review in light of Noel
Canning v. NLRB, 705 F.3d 490 (D.C. Cir. 2013), cert. granted __ S.Ct. __, 2013 WL 1774240 (U.S. June 24,
2013), and should await a decision by the U.S. Supreme Court or appointment of a lawful Board before proceeding
with this petition. For the reasons stated in Bloomingdale’s, 359 NLRB No. 113 (2013), this argument is rejected.
