Employer and INTERNATIONAL BROTHERHOOD OF TEAMSTERS, LOCAL 439 Petitioner Case 32-RC-144041 DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board has considered objections to an election held March 12 and 13, 2015, and the hearing officer's report recommending disposition of them. The election was conducted pursuant to a Decision and Direction of Election. The tally of ballots shows 33 ballots cast for and 12 ballots cast against the Petitioner, with 3 challenged ballots, an insufficient number to affect the results. No exceptions have been filed to the hearing officer's report within the time provided. Accordingly, the Board adopts the hearing officer's findings and recommendations, and finds that a certification of representative should be issued. 2 CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for INTERNATIONAL BROTHERHOOD OF TEAMSTERS, LOCAL 439 and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All full-time and regular part-time Road Drivers and City Drivers employed by the Employer at its 4520 S. Hwy. 99, East Frontage Road, Stockton, California terminal; excluding all other employees, Dockworkers, Driver Apprentices, Supplemental Dockworkers, Shop Technicians, office clerical employees, and guards and supervisors as defined in the Act.
