DECISION ON APPEAL
Pursuant to 35 U.S.C. § 134(a), Appellants 1 seek review of claims 22
and 30. We have jurisdiction under 35 U.S.C. § 6(b ). For the reasons set
forth below, we AFFIRM.
STATEMENT OF THE CASE
The Specification describes a method of expanding the number of
pluripotent stem cells and their use for the treatment of diseases. Spec. ,r 5.
Claim 22 is illustrative and is reproduced below:

22. A method of preparing a pluripotent stem cell population
compnsmg:
administering a composition to an adult human being
over a period of time wherein said composition includes a
plant-based cyanobacteria phytochemical for increasing a
number of pluripotent stem cells in an existing pluripotent stem
cell population in tissue and a bloodstream of said adult human
being, said pluripotent stem cell population comprising a
combination of epiblastlike stem cells, blastomere-like stem
cells and transitional cells, said administering of said
composition over a period of time based on one of the
following protocols:
