The Respondent and the General Counsel each filed a response to the Notice to Show Cause, in which they supported severing the allegations that certain work rules were unlawful and remanding those allegations to the judge. The Board has delegated its authority in this proceeding to a three-member panel. Having duly considered the matter, IT IS ORDERED that the allegations that certain work rules have been unlawfully maintained are severed and remanded to Administrative Law Judge Paul A. Bogas for the purpose of reopening the record, if necessary, and preparing a supplemental decision addressing the complaint allegations affected by Boeing, setting forth credibility resolutions (if necessary), findings of fact, conclusions of law, and a recommended Order. 1 Copies of the supplemental 1 On October 19, 2016, the judge denied the Respondent’s Motion to Allow Testimony Concerning the Region’s Investigation of the work-rule allegations.
