Feb. 17, 2017) Copy Citation Brooklyn, New York UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD EMLO CORPORATION and ASBESTOS, LEAD 7 HAZARDOUS WASTE LABORERS UNION LOCAL 78, LABORERS' INTERNATIONAL UNION OF NORTH AMERICA Case: 29-CA-135944 SUPPLEMENTAL ORDER A controversy having arisen over the amounts of backpay due the discriminatees under the terms of the Order1 issued by the National Labor Relations Board on September 3, 2015, and enforced by the United States Court of Appeals for the Second Circuit, the Regional Director for Region 29, on July 19, 2016, issued a Compliance Specification and Notice of Hearing. Pursuant thereto, a hearing was held before Administrative Law Judge Mindy E. Landow. Thereafter, on January 4, 2017, the Administrative Law Judge Mindy E. Landow issued her Decision and, on the same date, the proceeding was transferred to and continued before the Board in Washington, D.C. The Administrative Law Judge ordered that the Respondent make whole the Mason Tenders' District Council Trust Funds by paying delinquent fringe benefit fund contributions in the amount of $77,529.30 as set forth In Appendix A of the compliance specification and $2,323.88 in liquidated damages, as set forth in Appendix B of the compliance specification, for a total due of $79,855.18. 1 The unpublished Order adopts the Administrative Law Judge's findings and conclusions. No statement of exceptions having been filed with the Board, and the time allowed for such filing having expired, Pursuant to Section 10(c) of the National Labor Relations Act, as amended and Section 102.48 of the National Labor Relations Board Rules and Regulations, the Board adopts the findings and conclusions of the Administrative Law Judge as contained in her Decision, and orders that the Respondent, Emlo Corporation, its officers, agents, successors, and assigns, shall pay the amounts set forth in the recommended Order of the Administrative Law Judge.
