The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 60 ballots cast for the Petitioner and 59 ballots cast against the Petitioner, with 1 challenged ballot, a sufficient number to affect the results. No exceptions have been filed to the hearing officer's report within the time provided. Accordingly, the Board adopts the hearing officer's findings and recommendations,1 and finds that a certification of representative should be issued. 1 We adopt the hearing officer’s recommendation to sustain the challenge to the ballot cast by Kent Riedel. 2 CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for Communications Workers of America, AFL-CIO and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All full time and regular part-time cable splicers, cable splicer helpers, business communication technicians, central office technicians, customer service technicians, building operations repair persons, building operations mechanics and building operations technicians, employed by the Employer in its Winter Park, Florida District; excluding all other employees, specialists, IP business technicians, office clerical employees, professional employees, confidential employees, guards and supervisors as defined in the Act.
