The Respondent’s request for special permission to appeal from the June 4,
2012 and June 7, 2012 Orders of Judge Michael A. Marcionese is denied. The
Respondent has failed to establish that Judge Marcionese abused his discretion
regarding his determinations as to the Respondent’s questioning of the discriminatees.
This denial is without prejudice to the Respondent raising these issues on exceptions to
the judge’s decision, if appropriate.

The Respondent’s request to stay the hearing scheduled for June 26, 2012 is
also denied.
